Google is the subject of a class action lawsuit based on breach of warranty. The breach in question is Google’s non-responsiveness regarding the inability of their Nexus One phone to maintain 3G connectivity. HTC acknowledged the issue as a legitimate flaw – a flaw that was never fixed. The man spearheading the effort, Nathan Nabors of Florida, contends that Google did not sufficiently support its customers or ensure the functionality of one of the N1′s core features. Curiously, neither HTC or T-Mobile are named in the suit. The filings also point to possible Communications Act violations for false or misleading statements about the functionality of the Nexus One.
