Samsung Forced to Remove “Thermonuclear” Comments from Judiciary Arsenal

Another day, another round of litigation stories. Unfortunately, today is no exception. In the epic saga of Samsung vs. Apple, Judge Lucy Koh has denied Samsung the rights to use the late Steve Jobs’ “thermonuclear” comments in the courtroom. Samsung claims the comments are relevant as his statements speak to “Apple’s bias, improper motives and its lack of belief in its own claims in that they are a means to an end, namely the destruction of Android.” Koh, on the other hand, thinks otherwise, saying “I really don’t think this is a trial about Steve Jobs.”

Her decision is a shocking one, considering Judge Richard Posner allowed the comments, granted his trial vs. Motorola never happened. Even though he thought the comments could be cause problems, he allowed them with caution. The only thing the two judges seem to agree on is the fact that the comments could be potentially distracting. We will never know, though, as they are disallowed from the courtroom thus far.

Wow. This is no small matter. I urge anyone writing a blog, regardless of its focus, to post the following link along with any comments you feel are appropriate. And all you fellow Android users out there, tweet, text and email the following. I'd never read the comments before. I guess Apple tried to shove it under the table like all the rest of their questionable activity. The judge may not want it out there, but no reason we can make sure it is well known.

Isn't that obstruction of evidence? Samsung is right in saying that the quote speaks of bias.
