Judge Koh Getting Extreme, Asks Apple Attorneys If They’re Smoking Crack

The stories about Judge Lucy Koh continue. Once again, she has done something ridiculous, though this time it won’t affect the actual case. Usually, she makes decisions that badly affect the case for both sides, so it’s good to see her acting unprofessional WITHOUT hurting the case.

Apple submitted a 75 page briefing on 22 rebuttal witnesses that they could call out if necessary after Samsung’s presentation. Apparently, Judge Koh didn’t like that. It’s understandable that she’s upset because that massive document is a waste of court time. However, you judge your reaction for yourself.

Judge Koh asks why Apple would present such a long document “when unless you’re smoking crack you know these witnesses aren’t going to be called!” Woah woah woah, Koh. That’s mighty unprofessional of you! Apple attorney William Lee responded “First, your honor, I’m not smoking crack. I can promise you that.” Good to know. Then Apple agreed to shorten the document while stating that they did believe they would have the time to call every single witness, and that some of them were Samsung’s witnesses, not their own.

Let’s be honest: even if that document was a waste of the courts time, that reaction was still completely unwarranted and unprofessional. They really need to switch out the judge for one that’ll be fair and reasonable to both sides.

With all of the crap she has been putting up with form both sides, this is just showing us that she is a Human Being. Let's be glad she didn't trow something at them>

Actually, I find judicial comments like this rather refreshing and appropriate. They are also not all that uncommon. I submit the following actual language used in recent judicial/court opinions and rulings:

 

"Certain chancery staff have experienced a troubling side effect to reading this evidence: Lionel Richie’s 1980’s treacle, ‘Hello,’ came to mind and is stuck in their heads.”"In one of his ballads, Jim Croce warned that there are four things that you just don’t do: 'You don’t tug on Superman’s cape/ You don’t spit into the wind/ You don’t pull the mask off that old Lone Ranger/ And you don’t mess around with Jim.' He could have added a fifth warning to that list: 'And you don’t let a pistol-packing mother catch you naked in her daughter’s closet.'” 

 

"The trial transcript quotes Ms. Hayden as saying Murphy called her a snitch bitch “hoe.” A “hoe,” of course, is a tool used for weeding and gardening. We think the court reporter, unfamiliar with rap music (perhaps thankfully so), misunderstood Hayden’s response. We have taken the liberty of changing “hoe” to “ho,” a staple of rap music vernacular as, for example, when Ludacris raps “You doin’ ho activities with ho tendencies.”

 

I saved the best for last: a judge who quoted Adam Sandler in explaining why he denied a motion:

 

"Mr. Madison [Sandler’s character], what you’ve just said is one of the most insanely idiotic things I’ve ever heard. At no point in your rambling, incoherent response was there anything that could even be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no point, and may God have mercy on your soul."

Fuck yeah. This Judge is awesome, I don't care how unprofessional that was. I think she actually gets it. These court cases are ridiculous and she's fed up with Apple's shit. I say, "Hoorah!".
