Court of Appeals to Judge Koh: Do-Over on the Samsung Galaxy Tab 10.1 Injunction

It seems like these Apple-Samsung lawsuits are never ending.  However, the news today is that something has finally gone in Samsung’s favor after being completely ripped apart by Apple. Recently, Judge Koh denied to lift the injunction on sales of Samsung’s Galaxy Tab 10.1 tablet even after rulings  that the device did not infringe on Apple’s design patents, citing lack of jurisdiction.  Today, the Court of Appeals has put their foot down and provided Samsung with a  motion for a limited remand of its appeal of the design-patent-based  preliminary injunction against the Galaxy Tab 10.1 (this lawsuit stuff is a mouthful).  This gives Samsung another chance with Judge Koh to argue the lifting of the injunction on the 10″ Android tablet.  It seems like Samsung has a logical argument seeing that the jury failed to find infringements with the tablet design patents in which the injunction is based on in the first place.  So, if you guys aren’t sick of this yet, do you think Judge Koh will finally come around?  Or do you think Apple’s lawyers will be just as convincing as before?  Let us know your thoughts by commenting below…

I don't have the time, or inclination, to go thru all the to-ing and fro-ing of Judge Koh's deliberations.  but I am puzzled as to why the case went to jury.....only to have the jurys finding overuled by Koh ?  Secondly.....apparently she didnt even wait for a report to arrive on her desk, to read it.....and upheld her decision in favour of APPLE. So, how then does she avoid the appearance of predjudice in light of this  ?  I havnt yet seen any analysis of this, and it puzzles me no end.

@Steamshovel: hi ken. The reason a jury was involved was because crab Apple demanded it. Nonetheless, your observations of the judge's apparent bias have been observed by many.

There you are! I was beginning to believe that the world was Apple-shaped... And we are revolving around its silly outburst about who stole what from who. Unfortunately for Apple Im a die-hard Samsung "active" supporter and you'd see this from my kitchen to my tv room. I will even take it as far as converting an Apple lover in my household...he owns an iPhone 4 & is excited about getting the 5... We'll see about that. Koh please stop standing in the path of awesome technology... I blame you for everything, from the delays in my updates (Still waiting for ics on my tab 10.1) to global warming.

Tides come in and tides go out. Its time for the tides to change in Samsung's favor. Especially when, in this particular case, even the jury and the law seem to agree that this device should not be prevented from selling.

 

As far as the outcome: It is inconsequential to me. Samsung will continue selling equipment. I will continue buying their products. Apple will continue selling their stuff. I will never buy from anything them, not even their coolaid.

 kanoneyez Same here.. And somehow if Apple got into the sugary drink business, they would find some way to sue the Kool-Aid mascot, because he somehow infringed on some obscure Apple design patent and Jude Koh would back them up 100%... OOOOOHHH YEEEAAAH!
