While Samsung has already described their unwillingness to settle with Apple, that doesn’t mean they don’t want a sneak peek at the details behind the Apple, HTC settlement. On Friday afternoon Samsung filed a request seeking a copy of the licensing agreement Apple has with HTC. Samsung says its wants to see what patents are covered and if those patents overlap as part of their case with Apple.
“As you know, the issue of Apple’s willingness to license its patents was briefed in Samsung’s opposition to Apple’s motion for permanent injunction,” wrote Quinn Emanuel’s Robert Becher, who is representing Samsung in the case. “This license has direct bearing on the question of irreparable harm and whether monetary remedies are adequate.”
Samsung has asked that the court decide if it can see the documents prior to November 27th, almost 10 days before both Samsung and Apple are due back in court. The December 6th court date hearing is set to decide amsung’s motion to dismiss the judgement against it due to juror conflict as well as Apple’s request to ban 8 Samsung products in the US.
Samsung declined to comment on the filing.
