Samsung Loses Another Patent Case To Apple, This Time In The Netherlands

Looks like this time around, Apple is the winner again. Samsung lost a case against Apple today involving patent EP 2.059.868.

So what does this mean for Samsung? This means that Samsung has 8 weeks to give all of their devices running Android 2.1 Eclair, Android 2.2 Froyo, and Android 2.3 Gingerbread updates to include the blue, bounce effect when scrolling in the gallery. If Samsung fails to send out these updates to those devices within 8 weeks, they will be fined 100,000 Euros a day, or $128,974 a day.

The Samsung Benelux issued a statement saying that they were disappointed in the court of Netherlands’s decision.

“Apple wants to restrict consumer choice and discourage innovation with their excessive and incorrect legal claims… We take all possible measures to protect consumer choice in the Netherlands.”

Well Samsung better get to work quick because they have 8 weeks to work on a massive amount of updates, and they do not want to lose any more money because of Apple. Hopefully Samsung turns this whole battle around in their hearing against Apple in December.
